1. Service provider and contact

These terms are made available free of charge before use and may be saved by the user.
Missing provider identity is a P0 issue and must not remain in the public release.
2. Service, eligibility and account
The test MVP may provide pseudonymous peer matching and calls, AI Avatar chat, short calls with invited MamPomoc Specialists, challenges, breathing, meditation and growth-oriented games, safety reports, moderation and technical call-quality measurement. Paid sessions and subscriptions are not part of this version.
Users must be at least 18. A contract starts when the user accepts these terms and begins using the service. A technical anonymous account still has a pseudonymous identifier and metadata; anonymous means identity is not required to be shown to the peer, not that the Platform processes no data.
3. Technical conditions and peer privacy
A current browser or supported app, internet access and JavaScript are required. Camera and microphone permission is required for video. Availability and quality depend on the device, network, firewall, signaling and TURN.
WebRTC may connect directly or through TURN. A direct P2P connection may expose a public IP address to the peer device. The Platform does not record or transcribe peer audio/video in the current MVP, but cannot prevent recording with external software or another device.
4. Wellbeing scope and emergencies
Except for a separately and clearly defined professional service, the Platform is not a healthcare provider, therapy, diagnosis or emergency response. Peer statements, Avatar replies and exercises are supportive, informational or developmental and do not replace advice from a doctor, psychologist, psychotherapist, lawyer or other qualified professional.
The Platform is not continuously monitored by a person and cannot guarantee crisis detection. If life or health is in immediate danger, call the local emergency number and use the current local crisis resources shown in the Platform.
5. AI Avatars
- The Avatar is clearly identified as AI from the first interaction and throughout the chat.
- A Jung-inspired Avatar is not Carl Gustav Jung, is not conscious, does not form a therapeutic relationship and cannot diagnose.
- Replies are probabilistic and may be wrong, incomplete, outdated or overly confident. Verify important information with a qualified person.
- Messages are sent to external AI providers described in the Privacy Policy. Do not enter identifying details, medical records or third-party data.
- Automated crisis detection only displays resources; it is not diagnosis, monitoring or emergency intervention.
6. MamPomoc Specialists
This feature connects a user with an invited account that has a MamPomoc.pl profile. The displayed name, role and profile should be used to verify the person's stated qualifications. The label Specialist does not automatically mean doctor, psychologist or psychotherapist.
A free MVP call is brief, introductory and supportive. It does not guarantee therapy, diagnosis, coaching, a prescription, records, crisis care or further availability. The legal roles of HappyGo/MamHumor, MamPomoc and each Specialist must be finalised before public launch or payments.
7. Challenges, breathing, meditation and games
- Participation is voluntary. Skip or stop at any time without giving a reason.
- These tools support reflection, conversation and healthy personal growth; they are not psychological tests, treatment, diagnosis or a promised outcome.
- Do not use them while driving, operating machinery, in water or where full attention is needed.
- Stop if you experience pain, severe dizziness, shortness of breath, panic, numbness or worsening wellbeing and seek appropriate help if needed.
- A shared exercise requires ongoing agreement from both people. It must not require physical risk, disclosure of personal data, contact with an abuser, spending, substances, unlawful conduct or stopping treatment.
This does not exclude any mandatory liability or consumer right.
8. Conduct and recording ban
- Respect boundaries, refusal, silence, disabled features and ending a call.
- Nudity, exposed genitals, masturbation, pornography and sexual conduct are prohibited even if a peer agrees.
- Threats, violence, harassment, hate, scams, manipulation of vulnerable people, encouragement of self-harm, impersonating a professional and attempts to contact minors are prohibited.
- Recording, screenshots, live streaming, showing the call to third parties, publishing it or using it to train AI are prohibited. Peer consent does not waive this Platform rule.
9. Reports, moderation and appeals
The Platform may end a call, restrict matching, suspend or ban an account or device to protect users, comply with law and enforce these rules. Some steps may be triggered automatically by reports and risk signals.
A significant restriction should provide an understandable reason category and access to human review at [SAFETY EMAIL]. Malicious reports are prohibited. Details of action against another person may remain confidential.
10. Content, availability and liability
Users retain rights in their words and image and allow only the temporary technical transmission needed for the session. Platform software, branding and content libraries are protected.
The provider remains liable under mandatory law and does not exclude non-waivable consumer rights. It does not promise a match, emotional outcome, uninterrupted test service or correct AI output. High-impact health, safety, financial or legal information must be independently verified.
11. Complaints, changes and governing law
Complaints may be sent to [COMPLAINTS EMAIL] with contact details, a concise description, approximate time and requested outcome. Do not send recordings or unnecessary third-party data. A response will be provided within 14 days unless applicable law requires otherwise.
Material changes receive a new version and may require renewed acceptance. Polish law applies without removing mandatory protection available under the law of a consumer's habitual residence.
